Duty of owner of motor vehicle to give information

The vehicle owner must, when an authorised police officer asks, provide any information they have or can reasonably find about the driver or conductor: name, address, and the licence held. This duty applies when the driver or conductor is accused of an offence under the Act. The information must be given to assist police enquiries.

Example

Priya owns an auto and her driver is accused of reckless driving. An authorised police officer asks Priya for the driver’s name, address and licence details. Priya must give whatever details she has or can reasonably find to the officer.

The owner of a motor vehicle, the driver or conductor of which is accused of any offence under this Act shall, on the demand of any police officer authorised in this behalf by the State Government, give all information regarding the name and address of, and the license held by, the driver or conductor which is in his possession or could by reasonable diligence be ascertained by him.
