Copy of order to accompany summons or warrant

When a summons or warrant is served or executed, the officer must give the person a copy of the order that authorised it. That copy must be handed to the person served or arrested so they know the legal basis for the action.

Example

Rohan runs a tea stall on a pavement that is under a clearance order. When officers serve a summons and later arrest him for not clearing, the officer must hand Rohan a copy of the clearance order along with the summons or warrant.

Enacted text

Every summons or warrant issued under section 132 shall be accompanied by a copy of the order made under section 130, and such copy shall be delivered by the officer serving or executing such summons or warrant to the person served with, or arrested under, the same.
