Discharge of person informed against
AI Assist
Summary
After an inquiry into whether a person should be required to give a bond to keep the peace or maintain good behaviour, the magistrate records the finding. If the inquiry shows no such necessity, the magistrate enters that on the record and releases the person if held only for the inquiry, or discharges them if not in custody.
Example
Rohan is accused of threatening his neighbour and the magistrate conducts an inquiry. The magistrate finds a bond is not necessary, records that finding, and since Rohan was only in custody for the inquiry, releases him.
Bare Act
Enacted textIf, on an inquiry under section 135, it is not proved that it is necessary for keeping the peace or maintaining good behaviour, as the case may be, that the person in respect of whom the inquiry is made, should execute a bond, the Magistrate shall make an entry on the record to that effect, and if such person is in custody only for the purposes of the inquiry, shall release him, or, if such person is not in custody, shall discharge him.
