Ordinary place of inquiry and trial

AI Assist

Summary

Offences are ordinarily investigated and tried by the court whose local jurisdiction covers the place where the offence occurred. That means the police inquiry and any trial should normally take place in the local court for that area.

Example

Priya files an FIR after her phone is stolen at the neighbourhood market. Under this rule the inquiry and any trial should normally be held in the court that has jurisdiction over that market area.

Bare Act

Enacted text
