Summary

When it is unclear in which local area an offence was committed, or the offence happened partly in different areas, or is continuing across more than one area, or consists of several acts in different areas, any Court having jurisdiction over any of those areas may inquire into or try the case. This lets prosecutors pick a competent Court from among the relevant areas so the case is not left without a forum.

Example

Priya reports a theft: the thief entered her shop in Area A, ran through Area B, and dumped the stolen goods in Area C. Because the offence took place across multiple local areas, any Court that has jurisdiction over Area A, B or C may inquire into or try the case.

  • (a) When it is uncertain in which of several local areas an offence was committed, or

  • (b) where an offence is committed partly in one local area and partly in another, or

  • (c) where an offence is a continuing one, and continues to be committed in more local areas than one, or

  • (d) where it consists of several acts done in different local areas, it may be inquired into or tried by a Court having jurisdiction over any of such local areas.
