Offence committed on journey or voyage

Summary

If an offence takes place while the person concerned or the thing involved is on a journey or voyage, any Court whose local jurisdiction that person or thing passed through during the journey may inquire into or try the offence. This allows Courts along the route to take jurisdiction instead of only the place where the journey began or ended. The result is that the case can be tried at a convenient point on the route.

Example

Priya is travelling by train with a parcel that is alleged to contain stolen goods. The parcel passes through three districts and is seized in the second district. Under this rule, the Court whose area the parcel passed through can inquire into or try the offence, so Priya’s case may be tried at that second district.

When an offence is committed, whilst the person by or against whom, or the thing in respect of which, the offence is committed is in the course of performing a journey or voyage, the offence may be inquired into or tried by a Court through or into whose local jurisdiction that person or thing passed in the course of that journey or voyage.
