Offence committed outside India
AI Assist
Summary
An offence committed outside India by an Indian, or by a non-Indian on a ship or aircraft registered in India, can be treated as if it happened at any place in India where that person is found. That lets Indian police or courts take action against the person here. However, no inquiry or trial in India may proceed without the prior sanction of the Central Government.
Example
Ravi, an Indian citizen, hits someone while on the high seas. If he later comes to India or is found here, authorities can treat the act as if it occurred where he is found and arrest or try him. But before any inquiry or trial in India proceeds, the Central Government must first give permission.
