Summary
Electronic records may be proved only in accordance with the rules laid down for electronic evidence (see section 65B). This applies when a party seeks to rely on emails, computer files, CCTV footage or other electronic data in court. If the conditions and certification required by 65B are not met, the court may refuse to admit the record.
Example
Ravi presents a CCTV clip to prove damage to his shop. To get that clip admitted, he must have it proved according to section 65B, including any required certification. If he cannot meet those requirements, the court may refuse to admit the clip as evidence.
