Section143
When they may be asked
AI Assist
Summary
Leading questions are allowed when a witness is being cross-examined. The cross-examiner may suggest facts or put words into the witness's mouth to test their account. This exception does not apply to a witness's own examination (examination-in-chief), where leading questions are generally not permitted.
Example
Priya is cross-examined about where she was the evening of a dispute. The opposing lawyer asks, "You were at the shop at 6 pm, were you not?" Under this section that leading question may be put to Priya to test her testimony.
