Restrictions on the holding of driving licenses

Summary

A person may not hold more than one valid driving license at the same time, except for a learner’s license, a specially issued licence under the rules, or a document authorising someone to drive. A driving license or learner’s license must not be lent to or used by any other person. The licensing authority can add more vehicle classes to a holder’s license.

Example

Priya has a valid car driving license and applies for another full licence for commercial vehicles. She cannot lawfully hold two full driving licences at once; only a learner’s license or a special authorising document is allowed as an exception. If she lends her licence to Rohan to drive, that would also be prohibited.

Enacted text

(1) No person shall, while he holds any driving license for the time being in force, hold any other driving license except a learner’s license or a driving license issued in accordance with the provisions of section 18 or a document authorising, in accordance with the rules made under section 139, the person specified therein to drive a motor vehicle.

(2) No holder of a driving license or a learner’s license shall permit it to be used by any other person.

(3) Nothing in this section shall prevent a licensing authority having the jurisdiction referred to in sub-section (1) of section 9 from adding to the classes of vehicles which the driving license authorises the holder to drive.
