Special provisions in regard to transport vehicles

AI Assist

Summary

Central Government may notify, for each make and model (except motor cabs), the maximum gross vehicle weight (GVW) and maximum safe axle weight after considering tyres and other factors. On registration the authority must record and the owner must display unladen weight, tyre details, GVW, registered axle weights and passenger capacity if any. The certificate cannot show weights different from the notification unless the Central Government allows local exceptions; the authority may require production of the registration certificate to revise GVW.

Example

Ravi buys a goods truck. At registration the officer records the unladen weight, tyre number/type/size, the GVW and each axle's registered weight, and these appear on the certificate; Ravi must display the same particulars on the truck. If his locality needs heavier limits, the Central Government can permit modifications; to change the GVW the authority may ask Ravi to produce the registration certificate.

  • (d) if the vehicle is used or adapted to be used for the carriage of passengers solely or in addition to goods, the number of passengers for whom accommodation is provided, and the owner of the vehicle shall have the same particulars exhibited in the prescribed manner on the vehicle.

Provided that where it appears to the Central Government that heavier weights than those specified in the notification under sub-section (1) may be permitted in a particular locality for vehicles of a particular type, the Central Government may, by order in the Official Gazette direct that the provisions of this sub-section shall apply with such modifications as may be specified in the order.
