Affidavit in proof of conduct of public servants
AI Assist
Summary
When an application in any inquiry, trial or other proceeding under the Code alleges facts about a public servant, the applicant may prove those facts by affidavit. The court may also direct that evidence on such allegations be given by affidavit. This lets parties use sworn written statements instead of, or alongside, oral testimony.
Example
Priya files an application during a trial alleging a municipal officer tampered with records. She may support that allegation by filing an affidavit, and the court can order that the evidence about the officer be presented by affidavit instead of oral testimony.
Bare Act
Enacted textWhen any application is made to any Court in the course of any inquiry, trial or other proceeding under this Code, and allegations are made therein respecting any public servant, the applicant may give evidence of the facts alleged in the application by affidavit, and the Court may, if it thinks fit, order that evidence relating to such facts be so given.
