Special provisions as to evidence relating to electronic record

Electronic records are proved by following the special procedure laid down for electronic evidence. This applies whenever an electronic document is used to establish a fact in court. The consequence is that such records are admissible only if they meet the required authentication and formalities for electronic evidence.

Ravi emails a scanned invoice to a supplier and later sues for non-payment, relying on that scan as proof. The court will admit the scanned electronic record only if it is proved according to the special electronic-evidence procedure, with the required authentication and certification.
