Copy of order to accompany summons or warrant

Every summons or warrant must be accompanied by a copy of the underlying order that authorised it. The officer who serves or executes the summons or warrant must give that copy to the person served or arrested. This ensures the person knows the grounds for the summons or arrest.

Example

Priya is arrested on a warrant issued because she failed to appear in court. The officer executing the warrant hands Priya a copy of the order that authorised the warrant, so she can see why she was arrested.

Enacted text

Every summons or warrant issued under section 113 shall be accompanied by a copy of the order made under section 111, and such copy shall be delivered by the officer serving or executing such summons or warrant to the person served with, or arrested under, the same.
