Commencement of period for which security is required
AI Assist
Summary
When a magistrate orders a person to give security while that person is serving, or has been sentenced to, imprisonment, the period for which security is required starts only after the prison sentence ends. If the person is not in prison when the order is made, the security period begins on the date of the order unless the magistrate, for sufficient reason, fixes a later date.
Example
Ravi is serving a three-month jail term when a magistrate orders him to furnish security for good behaviour for one year. Under the rule, the one-year security period will begin only after Ravi's three-month sentence expires.
Bare Act

(2) In other cases such period shall commence on the date of such order unless the Magistrate, for sufficient reason, fixes a later date.
