Commutation of sentence of death

AI Assist

Summary

When a court sentences a person to death, the appropriate Government may reduce that sentence to any other punishment the Code allows. The Government can do this without the offender's consent. The result is the death penalty may be replaced by a lesser punishment such as life imprisonment.

Example

Priya is convicted of a capital offence and the court sentences her to death. The appropriate Government may commute her death sentence to life imprisonment or another punishment under the Code, without Priya's consent.

Bare Act

Enacted text

In every case in which sentence of death shall have been passed, the appropriate Government may, without the consent of the offender, commute the punishment for any other punishment provided by this Code.
