Section63
Amount of fine
AI Assist
Summary
When a law or sentence does not fix a maximum, there is no statutory cap on the fine a court may impose, but the fine must not be excessive. Courts set the amount based on the offence, facts and the offender’s means. The rule prevents arbitrary or oppressive fines.
Example
Priya runs a small tea stall and is convicted under a bylaw that does not state a maximum fine. The magistrate can impose any amount appropriate to the offence and Priya’s means, but must not order an excessive fine.
Bare Act
Enacted textWhere no sum is expressed to which a fine may extend, the amount of fine to which the offender is liable is unlimited, but shall not be excessive.
