(Repealed) Sentence of Europeans and Americans to penal servitude

AI Assist

Summary

Allowed special sentences of penal servitude for persons described as Europeans and Americans, with a proviso for terms exceeding ten years but not for life. It applied when such persons were convicted of offences. The provision has been repealed and no longer operates, so ordinary sentencing rules apply.

Example

Priya, a European citizen in India, is convicted of theft. Under the old provision a court could order penal servitude and there was a special rule for sentences over ten years, but that provision has been repealed, so the court must follow the ordinary sentencing law instead.
