Person arrested to be informed of grounds of arrest and of right to bail
AI Assist
Summary
When someone is arrested without a warrant, the arresting police officer or other person must immediately tell them the full particulars of the offence or other grounds for the arrest. If the arrested person is not accused of a non-bailable offence, the officer must also inform them they are entitled to be released on bail and may arrange for sureties.
Example
Ravi is arrested without a warrant after a neighbour accuses him of stealing from a shop. The arresting officer must immediately tell Ravi exactly what offence he is accused of. Because the alleged offence is bailable, the officer must also tell him he can be released on bail and may arrange for sureties.
Bare Act
