Health and safety of arrested person

A person who has custody of an accused must take reasonable care of that person’s health and safety. The duty applies while the accused is detained and includes providing basic medical help, protection from harm, and safe conditions. It makes the custodian responsible for the accused’s wellbeing during custody.

Ravi is arrested and kept in a police lock-up. The officer in charge must arrange medical attention when Ravi reports chest pain and ensure the lock-up is safe. The officer is responsible for Ravi’s health and safety while he remains in custody.
