Police to report apprehensions

AI Assist

Summary

Officers in charge of police stations must report every person arrested without a warrant within their station limits to the District Magistrate, or to the Sub-divisional Magistrate if directed. The report must be made whether the arrested person is released on bail or kept in custody. This gives magistrates oversight of warrantless arrests.

Example

Ravi is taken into custody by local police without a warrant after a street scuffle. The officer in charge must report Ravi's arrest to the District Magistrate, or to the Sub-divisional Magistrate if directed, whether Ravi is admitted to bail or remains detained.

Bare Act

Enacted text

Officers in charge of police stations shall report to the District Magistrate, or, if he so directs, to the Sub-divisional Magistrate, the cases of all persons arrested without warrant, within the limits of their respective stations, whether such persons have been admitted to bail or otherwise.
