Arrest to be made strictly according to the Code

Arrests must follow the procedures in this Code (CrPC) or any other law that provides for arrest. No one may be taken into custody by a method the law does not permit. An arrest made otherwise is not lawful and can be challenged in court.

Priya is taken into custody after a neighbourhood quarrel but the police do not follow the arrest formalities required by the Code. Because the arrest was not made according to the Code, Priya's detention is unlawful and she can apply to a court for release.
