Section25
“Fraudulently”
AI Assist
Summary
An act is 'fraudulently' done only when the person does it with the intention to defraud someone. Mere mistake, negligence or carelessness does not make an act fraudulent. Whether an act was done fraudulently matters because offences that use this word require proof of that dishonest intention.
Example
Rohan sells a mobile phone but tells the buyer it is his own, knowing it was stolen, to get a higher price. Because he acted with intent to defraud the buyer, his conduct is treated as done fraudulently under this rule.
Bare Act
Enacted textA person is said to do a thing fraudulently if he does that thing with intent to defraud but not otherwise.
