“Good faith”

An act or belief is not 'good faith' if it was done or held without due care and attention. This applies when someone tries to rely on good faith as a justification or defence. Careless or inattentive conduct cannot be protected by claiming good faith.

Priya lends her scooter to a neighbour after glancing at the brakes but not testing them. When the brakes fail and the neighbour is injured, Priya cannot claim she acted in good faith because she did not take due care and attention.
